Anthony N. Gaeta, Esq. has represented clients in significant litigationmatters in New Jersey and New York for nearly two decades. Mr. Gaeta hasappeared before both the trial courts and appellate courts, and in federalcourt including the District Courts of New Jersey and New York, and theSecond Circuit Court of Appeals. Mr. Gaeta was formerly a partner at aboutique NJ/NY trust and estate firm where he chaired the litigationdepartment for over ten years. Mr. Gaeta has been consistently recognizedas New Jersey SuperLawyers Rising Star & Top Attorney in both Trust andEstate Litigation and Business Litigation. Mr. Gaeta has lectured beforethe New Jersey Institute of Continuing Legal Education (NJICLE) on issuersrelating to Trust and Estate Litigation and Planning, including seminarsentitled, “My Client is Dead, Now What?” (2013) and “Using Trusts in EstatePlanning” (2014).Mr. Gaeta has extensive experience in the Trial Courts, Chancery Courts,and Surrogate’s Courts of both New Jersey and New York. Mr. Gaeta hastried cases to verdict, including a victory in Morris County where heattained a money judgment in excess of $100,000 while defendingcounterclaims exceeding $750,000. Mr. Gaeta also successfully attained ajudgment under the New Jersey Consumer Fraud of approximately $1,000,000for a client that was defrauded by home improvement contractors. In anestate litigation matter, he successfully removed the Administrator of twoNew York Estates and appointing his client as the Estates’ fiduciaryfollowing that Administrator’s removal. Mr. Gaeta has also successfullyresolved cases at various stages of the litigation process such as onmotions to dismiss or motions for summary judgment. For example, in amatrimonial action, Mr. Gaeta was able to attain a $50,000 judgment -without the need for a trial - against a client’s former spouse for alimonypayments that were fraudulently induced from his client because of theformer spouse’s fraudulent concealment of her civil union. Similarly, in acomplex commercial litigation case, Mr. Gaeta was able to convince theplaintiff to voluntarily dismiss his client from the case prior to hisclient having to engage in costly discovery. In a trust litigation matter,Mr. Gaeta successfully reformed an irrevocable life insurance trust whichwas the subject of a published opinion by the New York Courts: *I/M/OIrrevocable Trust of John Leondis*, 2011 N.Y. Misc. LEXIS 4427 (Sup. Ct.Nassau Co.).
