My husband and I hired Megan Burns (on the left in photo) to defend him from an unlawful arrest and DUI charge. Ms. Burns sounded competent and dedicated to defending the case during the intake phone call I had with her, but unfortunately after we hired her, she proceeded to take a series of steps that injured my husband's case as well as to be completely derelict in her duty by NOT taking a series of steps to defend my husband. Ms. Burns irreparably harmed the case by first and foremost not obtaining the discovery we asked her for, not dissecting the police report to find errors in the what was written by the Officer Travis Mosser of the California Highway Patrol, not immediately obtaining the expert witness report and ONLY obtaining 10 MONTHS after the arraignment. What was most disturbing Burns seemed to forget the principle that the burden of proof is on the CHP and that a case is tried on the facts and evidence at law and that a defendant is innocent until proven guilty.
I just completed a Bar complaint against Ms Burns stating the various ways she was derelict in her duty and failed to defend me properlyin an unlawful arrest where the California Highway Patrol took me to jail after I called them through 911 in an accident. Ms Burns failed in a number of way, the worst ones are: 1. Failed to gather evidence, expert witness testimony or any discovery of any kind to present to the DA. Instead she waited for the DA to offer a plea. My wife and I both told her that we wanted the case dismissed given then Civil rights and due process rights violations that took place. 2. She didn't spend any time interviewing me to understand the facts of the case and she did not examine the police report where she would have found a glaring error. She insisted that all that mattered was the police report, but if it has errors, how good is it? Any layperson knows that errors win in traffic cases, but she didn't bother. There are 10+ more points. Don't hire her or her firm.
