Mark Dausch is a shareholder and past co-chair of the Litigation Group of Babst Calland. He is an experienced trial lawyer who concentrates his practice on energy and environmental litigation. As lead trial counsel, Mr. Dausch has tried several high-stakes lawsuits in federal, state and administrative courts, as well as before arbitration panels. His trial work includes successfully representing businesses in multiple complex energy and environmental trials involving claims in the hundreds of millions of dollars.

Mr. Dausch’s energy litigation experience includes representing oil and gas producers, midstream companies and contractors in a broad range of litigation, including royalty, contract, construction, personal injury, toxic tort, nuisance, injunction, lease, title, municipal and zoning disputes.

In the environmental arena, he represents businesses in claims brought under the Clean Air Act, Comprehensive Environmental Response, Compensation and Liability Act, Resource Conservation and Recovery Act, Clean Water Act and state law equivalents. He also regularly handles complex environmental class actions and proceedings before environmental administrative courts, including permit and civil enforcement appeals.

Beyond energy and environmental litigation, Mr. Dausch has experience representing businesses in complex disputes involving product liability, warranty, contract, tortious interference, fraud, antitrust, unfair trade practices, and shareholder claims.

Background

Mr. Dausch graduated summa cum laude from Duquesne University in 2004 with a B.S. in Business Administration, concentrating in Economics. He received his J.D. from Duquesne University in 2007, where he graduated magna cum laude and served on the Editorial Board of the Duquesne Law Review. While in law school, Mr. Dausch also completed an externship with the Honorable David Stewart Cercone of the United States District Court for the Western District of Pennsylvania and served as a legal research assistant to Professor Kenneth E. Gray.

Memberships and Affiliations

Mr. Dausch is admitted to practice in Pennsylvania, Ohio and West Virginia and maintains bar admissions with multiple federal district courts. In January 2026, Mr. Dausch was appointed to serve a two-year term on the Pennsylvania Environmental Hearing Board Rules Committee. Mr. Dausch has also taught several legal writing and business law classes as an adjunct professor of law at Duquesne University.

In 2013, Mr. Dausch was selected by The Legal Intelligencer as one of only 38 “Lawyers on the Fast Track” in Pennsylvania. This recognition is given to attorneys under the age of 40 who have demonstrated excellence in four categories: development of the law, advocacy and community contributions, service to the bar and peer/public recognition. He was selected to the 2013 and 2015-2022 Pennsylvania Rising Stars lists (Thomson Reuters). Mr. Dausch has also been recognized in The Best Lawyers in America® for Commercial Litigation since 2025.
