Dave Kresin represents employees and small businesses in employment litigation matters including discrimination, retaliation, medical leave denial, restrictive covenant enforcement, unpaid compensation disputes, and wage and hour violations. He has been recognized as a Southwest Super Lawyer since 2021 and as Chambers USA Band 1 for Arizona Labor & Employment Lawyers (Mainly Plaintiff) since 2024. He is a member of the National Employment Lawyers Association, the Arizona Employment Lawyers Association, the American Bar Association Labor & Employment Section, and the State Bar of Arizona, Labor & Employment Section. He is licensed in Arizona, Kansas and Missouri, as well as the Ninth Circuit Court of Appeals. Dave received his Bachelor of Arts degree in 1994 from Cornell College of Iowa and his Juris Doctorate in 1997 from the University of Kansas School of Law, where he was a member of the Order of the Coif and the University of Kansas Law Review. Before moving to Arizona in 1999, Dave served as law clerk to the Hon. G. Thomas VanBebber in the U.S. District Court for Kansas. Dave has substantial experience in federal courts, state courts, private arbitrations, and administrative proceedings. A representative sample of Dave’s trial experience includes: a federal court jury verdict on behalf of an employee for failure to pay commissions as well as minimum wage and overtime violations; a federal court jury verdict on behalf of an employee for minimum wage and overtime violations and retaliation under the federal and state wage and hour laws; a state court jury verdict on behalf of an employee terminated in retaliation for reporting violations of Arizona law; a state court jury verdict on behalf of a corporation against a director/former employee who breached his fiduciary duties to the company; a state court jury verdict on behalf of individual defendants accused of race discrimination and harassment; a state court jury verdict on behalf of individual plaintiffs on contract and conversion claims; an arbitration award on behalf of an employee for violations of the Americans with Disabilities Act; an arbitration award on behalf of an employee deprived of his commissions; and an arbitration award on behalf of two corporate executives on breach of employment contract and statutory wage claims. Dave also has presented on a wide variety of employment law topics and authored several articles relating to federal employment law issues.
