That type of litigation can be expensive so I would suggest that you contact a law firm that specializes in motor vehicle/products liability claims. More than likely, they will know the history of your vehicle and whether there have been problems with it in the past. Most lawyers do not charge a fee for an initial consultation and will take a case like this on a contingency basis, meaning the lawyer does not get paid unless you do

You should contact your insurance company and determine if your wife is the on the car's policy that her brother was driving. If she is not on the policy, then she should not be liable. If she was the owner of the vehicle she may be found liable if she permitted her brother to use the vehicle.
