You should at least consult with a plaintiff's personal injury attorney to see if the other driver was negligent in causing the accident even though you didn't have insurance. If so, you still may be able to recover damages for your injuries and related expenses.

Technically, there are several propositions that could serve as a foundation for a legal action in this situation. I doubt that the case would ever reach any court, but certain arguments can be made that can persuade your school's principal, or the school district, or the city, that they don't really want to litigate this issue. However, there are several problems that have little to do with the law. First, I doubt that you (or your parents) will pay an attorney to represent you in this matter. It is also not likely that you will find American Civil Liberties Union or other public advocacy groups eager to defend your bathroom break rights. Don't take me wrong: I understand that this is about personal dignity, and am not inclined to look at it lightly. What I am trying to tell you is that ACLU and other civil rights' organizations have limited resources and must pick their battles. So you will have to be ready to knock on many doors and swallow many rejections before you might find an attorney who would take the case. Second, I have to ask you whether you though what would your 3rd period teacher do if you escalate this disagreement into a legal conflict. Let's suppose that, at some point, her superiors will tell her to back off, that she must let you (and other students) go to a bathroom whenever asked. Don't you think this will breed enough resentment that she will look for ways to retaliate? And we both know she can make your life truly miserable if she wants. Does it mean that I advise you to drop your cause and suffer silently? Of course not! What I propose is that you should try making the teacher see your point, convince her, win her over. Think through her reasons for establishing this policy, address them in your argument, and show why the policy is, nevertheless, wrong. This way, you have a chance of winning the point without going to war, giving the opponent a chance to reconsider her position and retreat without losing face; in short, you have a chance of winning without making the opponent your enemy. Master this art - and you will have a wondrous life. If you do your best but it does not work, give me a call to discuss the legal angles of your predicament.
