You didn't say how the accident happened, and this is important. You can recover damages if someone was negligent. If it was a result of a customer's negligence, you could sue the customer. If the an employee of the restaurant was negligent, you could bring a claim against the restaurant. You can recover medical bills, lost wages and pain and suffering.

Is teh school responsible if my daughter got injured in the gym due to not wearing the proper shoes when they had the activity?

Probably not. Talk with a local attorney because your state's law may be favorable. I say probably not because your daughter participated. She could have pointed out she didn't have the appropriate shoes. Also since it was health class and not gym, why would she get a 0 for the day? Finally, is it possible that the teacher told the class the day before they would be going to the gym? Talk about all of these issues with the local attorney.

Doesn't sound like much of a claim. You need a doctor to state whether there is malpractice involved, and you need to have significant injury The hospital will defend and your lawyer will spend maybe 20000 or more dollars fighting them for a couple years. To what end? For what? What do you expect to get? No lawyer would likely take such a case and you cant get there without a lawyer in this type case.
