That is not a question I can answer, but what I would do is contact an attorney who handles a lot of medical malpractice cases, and if he's willing to take your case, he will pay to have a physician review your medical records to determine whether the doctor deviated from the standard of care.

In NY, the Statute of limitations is 3 years unless the parking lot is owned by a public authority, such as a housing authority in which case you may have some problems.
