Nothing beyond property damage or other 1st party PIP benefits. Without a "serious injury" as defined under Ins. Law sec. 5102(d) - you cannot recover for pain and suffering. Good luck.

Is it too late to pursue her home owner’s insurance company for fees and compensation if I was hurt a week ago?

You have 2 years post incident to file suit for personal injuries that are causally related to the incident. However, the longer you wait to get treatment the better the defense argument that your need for medical care was not the result of this incident, but something else. You want to get medical treatment as soon as possible so your injury can be documented and treated.

Can I take someone to court to get money back?

Mark Joseph Leonardo
Answered by attorney Mark Joseph Leonardo (Unclaimed Profile)
Personal Injury lawyer at Dordick Law Corporation
An oral contract has the same validity as a written one, its obviously just harder to prove because the debtor typically lies about it. If you have proof of giving the money and he or she has no proof of paying it back, you seem to have a valid claim. Depending on the amount, you can sue in small claims court.
