Yes you can. Actually, the way it works is you bring the suit against the person at fault. His insurance company defends the suit, and pays whatever judgment you obtain, up to the policy limits. The individual is liable for any amount of the judgment above the policy limits. However, it is difficult to collect the judgment above the limits. It is one thing to obtain a judgment against an individual. Collecting is a different matter, and is much more difficult.

Maybe. Most homeowners policies have a med pay provision that pays $1000 if somebody gets hurt on your property - regardless of fault. It is not clear if this man was on your property. If you knowingly allowed your dogs off leash, off your property than you would be "negligent" and that is when your policy would pay - assuming he actually got hurt. They will need to investigate and see if this was an aggressive attack, etc.. and that may impact whether they decide to cancel your policy.

If you fear that she could hurt someone due to her addiction, then I would definitely recommend that you cut ties from her regarding the vehicle and the insurance just out of sheer safety. Technically, you would not be the one sued if she hurt someone while behind the wheel. However, if she owns a home with you, then someone may try to come after her portion of the home or at least place a lien on the home which could affect future attempts to sell the home.
