Am I liable for the personal injury?

Answered by attorney Jeffrey Wittenbrink
Personal Injury lawyer at Wittenbrink Law Firm
This question is dependent upon how the person was injured on the horse, and in whose "care custody and control" the horse was in. If the transaction was a true sale, even if you are taking credit the sale is a credit sale and the "owner" is the one who is responsible for the actions of the horse. In Louisiana there is no "strict liability" for personal injury cases involving horses.

No time limit on the settlement demand, however you have 2 years from date of accident to file suit and purpose of settlement demand is to resolve case before having to file suit. Therefore, as soon as you are done treating need to obtain all your medical bills and records and provide to carrier with settlement demand.

What can I do if my child was misdiagnosed by a doctor?

For a medical malpractice case to be worth pursuing there must be substantial permanent injuries. These kinds of cases are expensive and labor intensive. Only a severe injury warrants the costs, commitment and risk of loss that an attorney must assume.
