How long does it take to receive a check after my case was settled on 24th of October?

David F. Stoddard
Answered by attorney David F. Stoddard (Unclaimed Profile)
Personal Injury lawyer at The David F. Stoddard Law Firm
It depends on the type of case, and whether there is insurance coverage for it. If you sued somebody and obtained a judgment against them, and there is no insurance, you have your judgment, but if they do not pay, you may have to go through further proceedings to have the court attach? their property for sale. If they own no property, you may never get paid. If there is insurance it usually takes between 2 weeks and sometimes a couple of months.

How can I file for a personal injury suit?

James Peirce Kelaher
Answered by attorney James Peirce Kelaher (Unclaimed Profile)
Personal Injury lawyer at Kelaher Law Offices, P.A.
While you can pursue a claim for assault and battery on your own, I would highly recommend that you consult with an experienced personal injury attorney first. Since this was an intentional act, it will most likely not be covered by their homeowners insurance. Unless these people have significant liquid assets, you may spend almost $500 in filing fees and service of process fees only to obtain a judgment which would not be collectable. Perhaps if you were to meet with a good, experienced personal injury attorney, he or she may think of a way to frame your cause of action in negligence, so that the homeowner's insurance would cover your medical bills at least. Since the incident occurred on their property, their medical payments coverage might cover your medical bills up to the limit of their med pay coverage, but I would still consult with an attorney first so that you don't jeopardize whatever possible homeowners coverage there may be.

Is a bar liable for anything if they took someone outside before calling an ambulance to avoid liabilties?

It depends. Were any injuries she sustained made worse by what the bar did? If yes, then it might be worthwhile suing.
