If the settlement form is in the proper form then it will be extremely difficult to back out of the settlement. The other side will file a Motion to Enter Judgment based on the settlement agreement. Unless you have a statutory defense to the settlement agreement, then there is nothing you can do. Most mediated settlement forms contain the required language.

If you knew an xray should have been taken as the first step in diagnosing the belly ache, you should have refused to leave the ER until they did an xray, which only shows major fractures or other gross internal abnormalities. All of the medical expenses and time loss from your job should be submitted to the first hospital for payment. Certainly not by Medicaid.

If you go try to after her personally her insurance company will defend her anyway; that's what the coverage is for. She's still personally liable for any damages in excess of her insurance coverage, and she'll probably be required to pay restitution as a condition of probation if she doesn't want to go to jail. That said, however, most DWI defendants don't have piles of money lying around to pay judgments with, and what you get from her insurance carrier is about all you can count on getting. You should get a lawyer yesterday. It won't cost you money; it will make you money. Without a lawyer you will not get her insurer to pay you the true value of your case.
