It is true you can file on your own, but the rest is pure fantasy. There is no way you would get summary judgment. Even with liability admitted (and saying there is "no question" is not the same as an admission) there will still be a question of fact for causation and damages. There is no such thing as a "liability judgment." Your entire case is decided at one time. The attorneys for the insurance company for the person who hit you would use every trick available to try and get your case dismissed without giving you a dime. If it were as easy as you have described, there wouldn't be so many personal injury attorneys as no one would need an attorney.

Workers comp is one remedy which you appeared to have explored. You should follow up with your attorney. Depending on the circumstances, there may have been a negligence claim against others, including the parents of the child who threw the water from the balcony, to recover compensatory damages. The problem for you would appear to be statute of limitations, since you suggest the incident occurred on 8/20/2009 (more than 5 years ago).
