In Michigan the general rule is that a premises owner has a duty to maintain a safe premises. However, unless there is an exception to the open & obvious rule, or a statutory duty, the premises owner's general duty does not apply. In other words, if a defect is observable on casual inspection (such as a sticking up brick), the duty to maintain is not applicable. However, when the defect is not observable on casual inspection (a loose? railing), then the open & obvious defense does not apply and the general rule of keeping the premises safe applies. Since there are other exceptions to the o&o defense and there could be statutory duties that apply, it would be best for you to consult local Michigan counsel that regularly handle premises cases for a free consultation, so your specific facts can be explored.

Some people owe more on their vehicles than their car is worth, which is referred to as being "upside down" on their loans. One option is to go through your own company and see if they will give you a better deal for your car. You can also attempt to gather other market evidence of the value of your car. Your personal items that were destroyed in the accident should also be reimbursed to you separate from your car. Remember, in addition to your car you should receive a settlement above and beyond your medical expenses and wage loss. This should help with any additional out of pocket expenses for which you feel entitled.

No, you are not screwed. Take the summons to your automobile insurance company ASAP. Call first to be sure they know about the claim. Your insurer has to cover this since it insures your car and has to hire an attorney to defend you. The driver was given permission to drive by your daughter so the driver was a permissive user, which is not a bad thing for you. Any liability insurance he may have or his family may have is excess above yours. That is just the way it works in GA. You are not a proper defendant as you did not do anything wrong and the lawyer that is hired by your insurance company can file a motion to have you removed from the case.
