Let's get this straight: YOU allowed your friend's dog to play in your yard. It is your yard. Your dog attacked his. You were aware that he had a small dog. In order to prove liability, he has to show that your dog was known to be aggressive toward other dogs. The amount he is looking for is outrageous. Turn this over to your insurance company if you have not already done so. If you don't have insurance, find out how much it would cost for him to buy a dog of the same breed and age as the one that was injured, and offer him that.

I think you need to see a psychiatrist and make sure that you are functioning properly mentally. If you are, then you can get an attorney to investigate. What you say sounds more like what a person with paranoid schizophrenia would say than what would normally happen in court.

The problem is, that regardless of the malpractice (even if obvious and provable) these cases are very expensive and time consuming. It takes tens of thousands of dollars and hundreds of hours of attorney's time to bring a successful malpractice action. Doctors and hospitals know this, which means they can get away with malpractice if the result is such that it won't be "worth" pursuing from a lawyer's point of view. So the question really is, whether the failure to diagnose has made her recovery significantly more difficult than it would have been otherwise. If so, call a few med-mal lawyers in your area, maybe someone will be willing to take it.
