Will my worker's comp settlement be lowered if I'm on public aid?

Answered by attorney Joan M. Durkin (Unclaimed Profile)
Personal Injury lawyer at Durkin & Graham, P.C.
In Texas you can't "settle" work comp unless it was an injury 1989 or before. If you received work comp benefits they are not taxable, do not get reported to the IRS or Social Security, etc.. If you received a settlement of a personal injury lawsuit then to the extent that you are on Medicare/Medicaid, some of that money may have to paid or set aside for future medical. This is something that you MUST talk to your attorney about.

Can I sue him for something other than medical bills and my car like emotional distress?

James Peirce Kelaher
Answered by attorney James Peirce Kelaher (Unclaimed Profile)
Personal Injury lawyer at Kelaher Law Offices, P.A.
In Florida, you cannot recover non-economic damages unless you have sustained a permanent injury, impairment or scarring in the accident. If you were not injured, then you cannot recover. In Florida, if a driver is drunk you can sue him for punitive damages, which are the damages above compensatory damages. Your compensatory damages are limited to the monies for medical bills and lost wages that your PIP insurance on your care does not pay. His insurance will not cover punitive damages, so you might be able to get him to voluntarily pay money above and beyond the compensatory, otherwise you will have to get a verdict, and a judgment, against the guy, for punitive damages. In Florida, as well, he cannot bankrupt punitive damages.

What can I do if I had a car accident and is at fault but has no insurance?

Paul L. Whitfield
Answered by attorney Paul L. Whitfield (Unclaimed Profile)
Personal Injury lawyer at Paul Whitfield and Associates P.A.
You are liable for the damage. if you were driving with permission of the owner of the car you ought to be covered by his carrier you don't get a pass because you are a student or are broke. Liable is liable. Either you owe or the insurance carrier does. You might want to see a lawyer about the coverage issue.
