If a student is injured at school, is the school responsible for paying medical cost incurred from injury, when another student was involved.

Answered by attorney Diana L. Anderson
Personal Injury lawyer at Diana L. Anderson
I would need more information regarding how the injury occurred but it seems to me that the school and/or the child that poked your son is responsible for the medical bills, as well as the pain and suffering, but this is probably going to require litigation to get them to accept responsibility.  Has this other student ever assaulted anyone else?  Is there a history of this type of behavior?  Was the school negligent in supervising this student and/or correcting his/her behavior?  How old is the other student?  The students parents may be responsible for his/her behavior.   This is definitely something you should discuss with a lawyer because your son should be entitled to compensation for paid and suffering, not just reimbursement of medical expenses.

What am I entitled to?

Answered by attorney Diana L. Anderson
Personal Injury lawyer at Diana L. Anderson
You should contact a lawyer.  You have sustained injuries and damages for which you should receive compensation. your lost time at work will be part of the compensation you will receive along with pain and suffering.  Injuries to the back and neck are often permanent, and could reduce or impact your quality of life.  Even if the other driver is not insured, you may be entitled to compensation fromyour own car insurance. I can help you with this matter, feel free to contact my office for a free consultation.

What are my rights if I am the victim of aggravated assault by military personnel?

default-avatar
Answered by attorney Jeffrey Lapin (Unclaimed Profile)
Personal Injury lawyer at Lapin Law Offices
Assuming you are not in the military, were assaulted on non-military property, and the military personnel were not "on duty," then police should have been contacted after your assault. The people who assaulted you would be prosecuted by the city or county attorney. You also have the right to sue them for any injuries or damages you sustained. If any of my assumptions are wrong, such as you were assaulted on military property, then the case would likely fall within military law. I cannot comment on the military justice system as it is beyond the scope of my knowledge. Depending on the circumstances of your assault, you may want to contact an attorney who could better answer questions about your rights.
