After suing a car dealership in small claims court can I sue again in a higher court?

Answered by attorney Douglas Lee Bryan (Unclaimed Profile)
Personal Injury lawyer at The Bryan Law Firm L.L.C.
No, once a court decides the case, you usually can't file another suit surrounding the same issues. Also, in most small claims courts in Louisiana, you can't appeal to the court of appeals. If you feel your claim is for more than the jurisdictional limit of the small claims court, you may be able to have it removed to the regular docket or to district court. You may wish to speak to the clerk's office regarding that.

Can I sue the restaurant if I found roach in my food?

You can always sue anybody for anything, but that doesn't mean you're going to win and may even subject yourself to sanctions if you lose. If you never got ill and didn't go to the doctor, then what are your damages?

Does a home owner have to pay more for insurance if someone sues?

Answered by attorney Russell Mark Rubin (Unclaimed Profile)
Personal Injury lawyer at Rubin, Inc.
First, you would not sue the insurance, you would have to sue your sisters boyfriend. We don't say the word insurance in court on a personal injury case. The reason for the secret is to give the person (and their insurance company) a fair trial without the jury thinking, aww who cares is it just insurance money. Yes you could sue for this and if a known problem before the fall, you should have a good chance for success.
