Can I still sue my employer for an old injury?

Answered by attorney Jeffrey Wittenbrink
Personal Injury lawyer at Wittenbrink Law Firm
In Louisiana you may sue for a tort claim within one year of any accident, or one year of when you "knew or should have known" about a claim. Your claim for damages would have prescribed (passed the date at which it could be sued upon) quite some time ago. Further, you could not actually have "sued" your boss or your workplace, but instead would only have had a worker's compensation claim. The only exception is for an "intentional act," and asking you to lift too much would probably not be deemed "intentional" to the point of attempting to injure you.

If my husband was in an accident with life altering injuries and driver at fault is uninsured, what is our best recourse?

Dick Johnson

If you have an uninsured driver / vehicle that caused the injuries, and you have no other persons / entities to look to as liable parties, then you are going to have to go on your own auto Uninsured Motorist Coverage (UM), and your own auto Personal Injury Protection Coverage (PIP). PIP will exhaust with a limit of up to 10K, 25K or 35K, depending on which coverage limit you had in effect. Once PIP exhausts, then you go on your general health insurance coveage, such as Premera, Regence, Group Health, etc. Your spouse may also be eligible for Social Security Disability Insurance Benefits. If so, then your spouse is also going to be eligible for Medicare. Suggest that you consult with a lawyer who does injury / disability cases.

It's up to you to find out what's making you sick. There are companies that specialize in uncovering environmental hazards. It could be any number of things. Does your doctor have a clue about what's causing it? It's going to cost you to get to the bottom of this. But you may have a claim against your landlord if what's wrong is his fault.
