I was rear ended and have a sprained back is it worth it to sue? How?

James Peirce Kelaher
Answered by attorney James Peirce Kelaher (Unclaimed Profile)
Personal Injury lawyer at Kelaher Law Offices, P.A.
In Florida, you cannot collect for non-economic damages (pain & suffering) unless you have sustained either a permanent injury or a permanent impairment as a result of the injuries you sustained in the accident. If your treating doctor is not willing to give the opinion that you were permanently injured in the accident, the insurance company may offer you some small amount just to settle your case and clear the books, as they say.

How do I sue the other driver for the auto accident?

Answered by attorney Ernest Roy Krause (Unclaimed Profile)
Personal Injury lawyer at Ernest Krause Attorney at Law
Do you have the insurance information of the other driver? Call their claims department and tell them what happened. Keep a log of all phone calls. Get a copy of the police report. Your physician will tell you about your medical condition. You don't need an attorney just yet. The insurance company will pay your medical bills if no one else is doing it right now. When you find out how serious (or not-serious) your medical condition is get a free legal consultation. See if there is a State Bar approved Lawyer Referral Service in your area. An attorney referral from there would be fine. It seems like you have an "open and shut" case against the insurance company. An attorney would get one-third without, perhaps, having to do much. So get unbiased advice.

Can I reduce the cost of an auto accident judgment against me? How?

default-avatar
Answered by attorney Robert Andrew Michael Burns (Unclaimed Profile)
Personal Injury lawyer at Law Office of Robert Burns
The unpaid portion of a Judgment draws simple interest @ 10% per year. Your only way to avoid it is to work out a deal with the judgment creditor and that is usually done by paying it off at less than full value no some payment plan.
