What is my best course of action?

Answered by attorney Douglas W. Tuttle
Personal Injury lawyer at Tuttle Larsen, PA
What a mess.  I'm sorry that you are dealing with this.  I don't know what your lawyer has communicated to you during this process but I hope that he advised you along the way that this might be the outcome and gave you options to improve the situation.  I am surprised that he is asking you to negotiate the medical bills; most attorneys do this for their clients.  I suggest that you schedule a conference with the attorney so that you can ask him what his plan is for resolving both the case and the dispute with your medical provider.

If a person has fractured their foot from negligence of a company, how much do you ask to be compensated for?

Assessment of an appropriate settlement requires detailed analysis of liability and damages, including application of legal principles, evidentiary factors, medical documentation and experience in your jurisdiction as to likely range of prospective jury awards. Each injury is different and each individual responds uniquely to his injury. For example, there are many bones in the human foot, which one(s) of yours were broken? There are different types of fractures. Your age, employment and medical condition are factors. I could go on.

Don't sign a release or you will be giving up your right to sue in exchange for whatever money the insurance company agreed to pay you.
