How do I determime amount of settlement without leaving money on the table?

Answered by attorney David Scott Carlile (Unclaimed Profile)
Personal Injury lawyer at Carlile Craig, L.L.P.
It is not possible to accurately predict your cases value without knowing more facts. First, you should hire an attorney. The insurance company will definitely try to low ball you if you represent yourself. In my experience a settlement of 2 to 4 times the medical is a reasonable range on a soft tissue case with no need for surgery and clear liability. Nevertheless, all cases are unique so that is just a range. The insurance company will have to disclose how much insurance is available on the policy. The minimum in Texas is $30,000 for a non-commercial vehicle. If the truck that hit you is a commercial vehicle or business vehicle, then there is likely a larger policy limit.

Should I hire a better Lawyer for my case?

Answered by attorney Stephen Arnold Black
Personal Injury lawyer at The Law Office of Stephen A. Black
You always have the option to fire your current attorney and retain other counsel. Be aware that if you do, your prior counsel may have a lien for work done and a cost lien for expenses advanced.  Stephen Black, Attorney Offices in Houston, Tx and Orlando, Fl.

Can I still sue my employer for an old injury?

David F. Stoddard
Answered by attorney David F. Stoddard (Unclaimed Profile)
Personal Injury lawyer at The David F. Stoddard Law Firm
First, your could not sue in court for this as your exclusive remedy against your employer for this type accident is in worker's compensation, regardless of whether the employer's actions contributed to the accident. If you could sue in court, it is too late as there would be a three years statute of limitation. If you have not already brought a worker's compensation claim, it is too late for this also as there is a two year statute of limitation.
