It appears you are asking about a subrogation right with your own health insurance company.  You need to look at the contract between your health insurance and you in order to determine if they will reduce their lien so that you are able to put money in your pocket.   I would encourage you to discuss this with a lawyer in your area who does personal injury plaintiffs work, so you don't compromise your claim.   Before you sign anything...contact a lawyer...  Good luck...

As a non-client I cannot advise you whether or not your settlement offer is fair compensation. I can tell you that you have a legal obligation to repay your medical expenses and any emergency care providers - hospital, ER docs, EMS, etc. have a lien against any settlement.

In Indiana, the statute of limitations is 2 years for bringing a personal injury lawsuit. However if, for instance, you were under 18 when the injury occurred, the statute would not start running until you turned 18. There are other situations where the statute of limitations is tolled in Indiana. You should consult with a personal injury attorney in your area to see if you have a claim in your state.
