Can I sue my dad for sexually abusing me as a child?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)
Personal Injury lawyer at Richard B. Jacobson Associates, LLC
There is a fairly long statute of limitations for sexual abuse, and it has changed several times in the past few years. The latest I know is that the lawsuit must be brought before the victim's 35th birthday. So you should consult a lawyer very soon. Among other considerations: do your parents have enough money to pay a serious judgment? After all, you could get a judgment against them and it would be meaningless if they have no, or few, non-exempt assets. Also, proving that their wrong-doing was the direct, proximate, natural cause of your suffering will require at least one expert psychiatric witness.

Are we able to sue his estate for damages and what is the statute of limitation?

Answered by attorney Brian M. Wendler (Unclaimed Profile)
Personal Injury lawyer at Wendler Law, P.C.
Yes, you can sue the estate of the murderer. The statute of limitations is generally two years for this type of case in Illinois. Exceptions might apply to the statute of limitations depending upon the facts. If the murder occurred in another state the statute of limitations might be different. In this type of case usually the most difficult obstacle to overcome is the fact that the person who commited the crime has little or no assets in the estate. There might be insurance to cover the situation too but more facts are needed. You should consult a lawyer.
