Would I still have a case to sue for a hit and run accident?

Answered by attorney Robert Morrison Lucky (Unclaimed Profile)
Personal Injury lawyer at The Lucky Law Firm, PLC
In Louisiana, you have one year from the date of the accident to settle any claim you may have or to file a lawsuit against all liable parties. If you do not file suit within one year from the date of the accident, then you lose your legal right to recover from the liable parties. Since it has been 3 or 4 years since the accident, it does not appear that you have a legal right to recover against any party who may be responsible.

It may not be too late if you received payment from the insurance company and they did not warn you in writing that your claim must be resolved within 2 years of the accident date.

How do I fire my current attorney to minimize my costs to him/her and go with another that I feel comfortable with on my worker’s compensation case?

You should at least receive return calls from staff at the attorney's office. W Comp law offices are higher volume so many of the calls need to be returned by staff not the lawyer but there is no good reason that no one is returning your calls. I am familiar with this problem because I have been doing Workers' Comp for 38 years.
