Can I file a lawsuit against the driver who hit me from behind at a red light or against his insurance company?

Answered by attorney Andrew Tyler Velonis (Unclaimed Profile)
Personal Injury lawyer at Andrew T. Velonis, P.C.
The answer is: That's why they call it "No-Fault". Let's just hope it is not too late for you to file your claim. Contact your insurance company immediately and file a claim for no-fault benefits. Do it even if they tell you it's too late. Get a lawyer, there are other issues to be discussed. This is an excellent example of why people in your position should not try to handle their own legal claims. You make a very good explanation of your circumstances, you are correct that the other driver is at fault, and still they give you the run around. You also made a mistake: your no-fault covers your medical expenses and your time out of work, so you can get the medical treatment you need.

Can I sue for personal injury for losing part of a finger?

Answered by attorney Russell West (Unclaimed Profile)
Personal Injury lawyer at West Law Office
If your injury happened due to negligence on part of a homeowner you can sue or settle with their homeowners insurance. Losing part of a finger and having screws inserted is definitely worthy of a case. Liability will need to be assumed by the homeowner if they were at fault. If it was a simple accident with no negligence they may not be liable.

Do we have recourse if my husband had a foot personal injury?

Answered by attorney Salim A. Khayoumi
Personal Injury lawyer at Buchanan Law Firm, LLC
The smartest thing to do is hire an attorney licensed in the state where the injuries occurred. A personal injury and/or civil litigation attorney will have a much better chance at recovering ALL available remedies (or damages) stemming from the incident. One can always attempt to seek damages from the store by themselves (i.e. pro se); however, its best to hire a licensed experienced professional who has handled such types of cases.
