I agree with what my colleague Mr. Groff has written. I would only add that you need an experienced (preferably board-certified civil trial lawyer) to make contact with the at-fault driver's insurance company to determine whether in fact the at-fault driver has bodily injury coverage. Believe it or not, in Florida BI coverage is not mandatory.  If the at-fault driver has no BI coverage and you do not have underinsured/uninsured motorist coverage, then it does not make sense to sue him/her unless the driver has sufficient assets to satisfy a judgment.  If on the other hand, the driver does have BI coverage then oftentimes - even if you haven't yet had the surgery - the driver's insurance company will tender the BI limits upon receipt of a carefully drafted demand letter with supporting medical documentation. Bottom line, don't go it alone. Get yourself an attorney.

Is the cause of injury due to mechanism on the boat or the conduct of the person? What is the basis for the claim against the individual? Yes, your daughter can file the action until she reaches her 20th birthday, but you don't want to wait till them. If you witnessed the incident you had a claim but is now barred by statute of limitations. Good Luck.

Sorry to hear about your father. Well, certainly a dentist can pull teeth. Generally those cases are handled by endodontists and oral surgeons, however. The dentist should have been aware your father was on Coumadin and taken that into account. As for a case, it would depend on what the outcome might have been if an oral surgeon had done the procedure as opposed to a dentist. You should speak to an attorney so you can provide additional information.
