Unfortunately she is correct. If the item that caused injury is inherent in that food, the restaurant is not liable. For example, if you ate a chicken burrito, you would not expect a bone, but if there was a chicken bone that you bit and resulted in injury they would not be liable because the bone is inherent in any chicken dish, even if not expected. On the other hand, if you bit into a stone or a piece of glass, those items are not inherent in any chicken dish and the restaurant would be liable. Here, the stem is an inherent part of an avocado, even if not expected by you. Many insurance polices contain a med-pay provision that covers medical expenses up to a certain limit, oftentimes $5,000, regardless of fault. You only need to be injured on their premises. I would call her and ask if there is a med-pay provision on the restaurants policy and if so, what is the limit. If there is one, ask her why she is not covering all of your medical bills up to that limit. This is usually an area where adjusters take advantage when you are not represented by an attorney.

Incident reports are generally legal "work product" and do not have to be produced. Also, in 99% of cases - facilities are not not legally responsible for the intentional acts of other children. If your daughter was hurt badly, you will need to retain a lawyer to examine whether there is some liability on an insured or recoverable party.

I am having to do a lot of assuming here, but I am assuming that your daughter was injured in an automobile accident, and received a recovery and that money was put into a guardianship account of some nature. If that's the case, the answer to your question is "whatever the judge thinks will benefit your daughter that you cannot afford to give her." I have had circumstances in the past where I pretty well proved to the judge that my client's parents were barely scraping by, and the girl needed braces on her teeth. The parents couldn't afford to get her braces. Because of the fact that putting braces on the girl was time-sensitive, and couldn't wait until she was 16 or older otherwise it would be too late, the judge approved taking the money out of the guardianship account for the braces. Most judges look at the request and ask themselves, "is this something the parents should be providing for the daughter, and is it pretty much a necessity, and would it harm the child now not to release the money?" I would hesitate to guess how a judge would lean for a computer, desk & printer. Also, judges don't necessarily put a lot of emphasis on what a minor wants so much as what a child needs.
