Generally speaking, conversion involves the plaintiff having a right to immediate possession of personal property and the defendant wrongfully exercising control over the property. There are facts that need to be proven regarding the state of the property, your rights regarding it, and the type of deposit made by your father.

In small claims court, if you lose, the court could award Walmart its "court costs" but not attorneys' fees (unless your claim is based on a contract that has an attorneys' fee provision in it).
