Do I have any rights as JFK's daughter?

James Peirce Kelaher
Answered by attorney James Peirce Kelaher (Unclaimed Profile)
Personal Injury lawyer at Kelaher Law Offices, P.A.
Obviously you would have a very tough burden of proof. Coming from an Irish Catholic family, we all loved JFK, and I only remember him having three children: John-John, Caroline and the baby that Jackie lost in childbirth. If you can produce a birth certificate, attesting to your parents, then I would imagine if you gave a copy of it to any reporter, it would not be long before you would get the "notoriety" of being the daughter of a president of the United States.

What is the difference between strict liability and tortuous liability?

Richard Eugene Lewis
Answered by attorney Richard Eugene Lewis (Unclaimed Profile)
Personal Injury lawyer at Richard E. Lewis, P.S.
Negligence and Strict liability both will arise from a tort, in most cases. Strict Liability does not require proof of negligence. Still, you must prove that the injury arises out of the source that has strict liability. Normally, you are required to prove negligence to recover for a tort.

Can we file a claim on the other driver's insurance for the damage to my daughter's car?

James Peirce Kelaher

In Florida, there is a rebuttable presumption that the rear driver is at fault, not the front driver. Contrary to public opinion, it is not the officer's fault to determine who caused the accident, but if someone violated a statute. If he didn't think he could prove your daughter violated a statute, then he would not have charged her.
