Don't understand your question or why you asked it what is your purpose? What are you trying to do? Driving under the influence is a violation of the law under any circumstance. If your boss asked an employee to drive knowing he was impaired your boss is an idiot and does not deserve to be a boss. if someone were hurt as a result your boss would be guilty of aiding and abetting a drunk driver and would be responsible in damages along with the driver does this answer your inquiry?

Basically when someone tries to get a statement that someone else made outside of court to prove something, that is hearsay and is not admissible to prove what was said One exception is if someone admits something; that can be introduced. An adoptive admission basically means that someone makes a statement about someone else and that someone else either by word or conduct (sometimes even silence) expressed or implied that the statement was true. the jury instruction in california is CACI 213. The jury can then weigh that statement against the person (the someone else). If the jury does not believe that the someone else expressed or implied the statement was true they are not to consider the statement at all.

If you suspect that this person procured the POS through fraud, duress, undue influence, etc., contact the police immediately. It is elder abuse first of all. The problem is there are people that prey upon elders that cannot protect themselves and abscond with their money. You might need to retain an attorney to sue this person and try to unravel what they have done. The bank has the right to honor the POA, but you have the right to get the money back if you can prove a wrongful intent on the part of the person that took the money.
