It depends. Normally, what I do is find out the tort-feasor's insurance company, contact them, get them the information they need and then start negotiating. A variety of results can ensue. If I still think the case is worth pursuing, I will then file suit. Certain kinds of cases, though, I start with the lawsuit. Since you are contemplating a liability claim, contact an attorney in your area who handles the kind of case that you have, set up a meeting, and if he/she is interested in going forward, ask the lawyer to tell you what kind of approach he/she will use and why.
