Why would you be looking to sue the State, if I understand your question correctly?  Generally, only the person who committed the tort, the crime, is liable to those harmed by it.

The emergency room doctors have immunity in some states for everything except gross negligence. This is a result of the claims that doctors are doing the best they can and that lawyers are the problem. They call it "tort reform" but it's really bug business taking away your rights. Your case would be difficult under any circumstances. Take time now to put down in writing the events that occurred, dates, places, times, and who you spoke with and who might be a witness to the event. Then call a local medical malpractice attorney in your own state and give them your facts.

I do not think however is threatening to sue you would have a case against you, but if they want to sue you, you cannot stop them. An attorney may be able to get the case thrown out before it goes to trial.
