Can we sue the restaurant for getting sick from the food we ate?

Answered by attorney Michael K Mckell (Unclaimed Profile)

You may be able to sue the restaurant but you will have the responsibility of proving your case. You will need to receive a clear medical diagnosis which can directly linked to the food you received in the restaurant. You will also have to prove that you have been damaged. If you were sick for a couple hours the night after you ate at the restaurant then your damages will seem relatively minor.

Who is responsible for paying for my son's injury?

Answered by attorney Eric E Rothstein (Unclaimed Profile)
Personal Injury lawyer at Rothstein Law PLLC
Was there any supervision in the schoolyard? If this is a private school it may have medical payment coverage as part of it's insurance that would pay regardless of whether the school was negligent or not. A public school may have med pay depending on where it's located. If it's a public school you should serve a Notice of Claim within 90 of the incident to preserve your right to sue. I don't think you can legally hold the parents responsible. Speak with a personal injury lawyer asap.
