For the last 20 years, the WC law formula for settlements has been, 20% of the first $5,000, 15% of the next $5,000 and 10% of any amount after that for benefits secured for the first 10 years of the claim. Example: On a $20,000 settlement, the fee would be $2,750, which is $1,000 of the first $5,000, $750 of the next $5k and 10% or $1,000 of the remaining $10,000. If there was litigation and depositions, you could also have to pay costs over and above the attorney fee and should receive a list of those costs. In addition to this, some attorneys will also try to take a percentage of the total amount of benefits you have received during the time in which he/she represented you on you WC case. For instance, if the insurance company stopped providing medical treatment and as a result of your attorney's efforts, the medical benefits were approved and started again or the insurance company may also owe payment of some fees or costs and that was negotiated as part of the settlement. That part of the fees and costs is unique to each case. If you do not think your attorney obtained any benefits for you other than the settlement, you need to discuss that and have the breakdown of fees explained to you before you sign the paperwork.

You have 2 problems. There is a 3 years statute. And secondly how does anybody know how and when you arm was damaged? Your testimony? You are kidding. If you don't have medical testimony to back you up you have nothing anyway and you don't have anything.
