Can I pursue legal action if my legally parked car was hit by a drunk driver?

Answered by attorney Jon R. Moore
Personal Injury lawyer at Brown, Moore & Associates, PLLC
Unfortunately, you will be limited to the fair market value of your vehicle immediately prior to the impact. The fact that your vehicle recently had four new tires and a completely new air condition system, however, will add overall value to your vehicle. You may need an appraiser to give you an opinion about the fair market value of your vehicle. Unfortunately this number will not include the car payments that you'll have to make on a new vehicle. If you used your vehicle for your business, however, you may also be able to recoup loss-of-use value in addition to the fair market value of your vehicle.

Is there anything I can do and can the dealership take my car back if it’s not fixed in the 30 Days given?

I hope you, the victim, and all readers learn from this incident. Always call the police and insist on an accident report. You certainly have nothing a lawyer would be willing to work with, without it. Also, it's a good idea to talk about a "car accident" situation with a lawyer within a few days after it happens. Many lawyers, myself included, offer free phone consultations. In this specific case, you still have the option of suing (without a lawyer) the person who hit you in civil court for property damage.

What should we do if my daughter was in a rear-end collision?

If you have coverage, use it. you must locate the bad person and find out if they have coverage and report the claim to her carrier. See a lawyer if this confuses you.
