Do I have a case to at least get a refund plus extra expenses incurred against my plastic surgeon?

Answered by attorney Mark Richard West (Unclaimed Profile)
Personal Injury lawyer at Mark West
The question is did what the doctor did fall below the standard of care? Would your new doctor testify in court that the first doctor, as you stated, screwed up? In medical malpractice cases, you have to have medical testimony to prove what the doctor did fell below the standard of practice and caused your injury. This is very difficult to do and is where most medical malpractice cases are lost. The insurance carrier for the doctor will tell him not to pay you anything and they will deny anything wrong happened.

Should the insurance company cover rental vehicle?

Rental coverage is optional and you have to choose it and pay the premium. You should get minitort, however, which you can spend on whatever you like. It's $1000 here in Michigan.

Have I been mislead by my attorney?

Answered by attorney Steven A. Schwartz
Personal Injury lawyer at Joel H. Schwartz, P.C.
If you signed a release agreeing to the amount, you may be out of luck if your attorney already sent it in to the insurance company or reported the case as settled to them. Without a release signed, it is certainly your right to have another attorney review your file to see if you wish to switch attorneys. Your injury certainly seems to warrant more than $15,000. However, you did not explain WHY you fell. If you cannot prove that you fell because of someone else's negligence or wrongdoing, you may be entitled to nothing.
