If I had my ovaries and fallopian tubes removed in 2008 and I just had surgery for the same thing, can I do anything about it?

David F. Stoddard
Answered by attorney David F. Stoddard (Unclaimed Profile)
Personal Injury lawyer at The David F. Stoddard Law Firm
I am assuming you want to sue whoever did or did not do the 2008 procedure correctly? This is a medical questions. To successfully sue for malpractice, you need three things: 1. Evidence that the doctor/nurse deviated from acceptable standards of due care, either by act or omission. This is also referred to as negligence. A bad outcome, in of itself, is not evidence of negligence. You need a doctor to testify that the doctor/nurse was negligent. 2. Evidence that the negligence cause some harm. 3. Significant damages. If the negligence caused minor damages, it would not be economically feasible to bring a ,malpractice case, because the cost in expert witness fees would exceed your damages. I know some malpractice attorneys who require at least $500,000 in medical bills or lost wages caused by the negligence before they will consider the case.

Can be sued if a friend's dog was hit by a car because I didn't close the gate?

That is an interesting question. If you were paid to watch the dog and you were negligent, I don't see any reason why you couldn't be sued.

I know longer trust my lawyer what recourse do I have?

Answered by attorney Stephen Arnold Black
Personal Injury lawyer at The Law Office of Stephen A. Black
What you should do is you should discharge your lawyer, and retain new counsel. If this is a personal injury case, they are entitled to a lien on the case, provided that they've done actual work. Most personal injury lawyers don't do any work, they just try to settle the case on the phone with the adjuster, without filing a lawsuit where they begin spending thousands and thousands of dollars on expert witnesses and taking depositions to make sure the case is processed competently and successfully. Has your lawyer filed a lawsuit Or is he just trying to settle the case on the phone with the insurance company? You're always entitled to a second opinion during the course of your first representation, but you would have to reach out to one of us because we cannot solicit you pursuant to Florida bar rules and lawyers.com rules.
