Is he liable for my arm injury?

default-avatar
Answered by attorney Gregory M Janks (Unclaimed Profile)
Personal Injury lawyer at Gregory M. Janks, P.C.
In Michigan people are responsible for injuring other people if the injuries were foreseeable and caused by the negligence of the person you want to make a claim against. If someone saw you coming out of/or toward a door and slammed the door on you, that would likely be negligent. If they are insured by a homeowner's policy, it should provide coverage for medical expenses, disfigurement, pain and suffering, out of pocket expenses, etc. However, if the person did that intending to injure you, it would be more than negligent and any applicable insurance would likely not apply due to it being an intentional tort. You should consult a Michigan premises liability attorney with your facts and evidence for a free consultation.

Can I sue for pain and suffering for my 5 yr old daughter after minor car accident?

Scott Lawrence Anderson
Answered by attorney Scott Lawrence Anderson (Unclaimed Profile)
Personal Injury lawyer at McGarveyAnderson PLLC
Pain and suffering is one of the elements of damages an injured individual may seek. From what you have described, it sounds like your daughter has suffered a very serious injury to her neck. My first priority is to see that my clients receive the best medical treatment possible. A large portion of a personal injury claim is determined upon the injuries that are suffered, their long-term effects and how it effects the person. I would be happy to discuss your daughter's claim with you if you would like.

Is there a penalty for my representation to quit my case?

Answered by attorney Eric E Rothstein (Unclaimed Profile)
Personal Injury lawyer at Rothstein Law PLLC
If the case is already in suit, the attorney cannot withdraw unless a judge signs an order or you sign a consent to change attorney form. If the case is not in suit, most retainers have a subject to investigation clause and the attorney can likely withdraw any time except that the attorney cannot abandon you too close to the statute of limitations.
