Can I sue the apartment complex if I slipped on ice in the parking lot?

Yes you can sue the complex. You will be required to prove your case as well as your damages. If you slipped but did not sustain an injury you will not have a case. Slipping alone is not sufficient grounds for a claim. You must sustain an injury and it must be proven with medical records.

If not at fault for an auto accident . . . should the person not at fault file a claim with his/her insurance carrier?

Answered by attorney Chris Hoffman
Personal Injury lawyer at Make Right Law
Your daughter should contact a Colorado personal injury firm.  Unless her injuries are minor, it makes sense to hire a lawyer in these situations for several reasons.  For one, she is unlikely to be treated fairly by the insurance company for the at-fault driver.  Second, there are a lot of other issues beyond simply settling the case that will need to be addressed by a lawyer.  She should not delay in calling a lawyer and should not give any statements to any insurance company. You need to consult with a Florida attorney since the accident occurred in Florida, however three years after the accident is probably too long for you to be able to file a claim now.  The statute of limitations for a premise liability claim is typically one - three years, but you should ask an attorney in Florida for the period in Florida.
