What can I do if my daughter is being sued for a car accident?

Answered by attorney Phong Thanh Tran (Unclaimed Profile)
Personal Injury lawyer at Law Office of Pho Ethan Tran, PLLC
If you daughter is unable to pay her debts, including for the auto accident, she can apply for bankruptcy protection. That will stop all collection actions against her.

Can I get charged towing and holding fees if car title is not in my name?

David F. Stoddard
Answered by attorney David F. Stoddard (Unclaimed Profile)
Personal Injury lawyer at The David F. Stoddard Law Firm
They probably cannot make you pay the towing bill since you did not drive the car, or give permission for it to be driven. However, if you want the car back, you would have to pay the bill. I think who has title has less to do with it than the fact that the driver did not have permission.

If damages exceed the policy limit of the at fault, insurance refuse it and the jury awards five times the limit, who pays, the insurer or insured?

If you gave them a demand pre-suit which meets certain criteria, then the insurance company may be liable not only for the excess judgment but also for punitive damages.
