Does a Lawyer on notice of lien on settlement in a civil case have to communicate with the lien holder?

Paul L. Whitfield

Lawyer doesn't have to do anything but he ought to do so. Otherwise he might subject himself and the client to some liability. Obviously depends on precise circumstances and any contract obligations. Disbursement might be held up for Medicaid or medicare or some such why not just ask the lawyer whats up.

Can the insurance sue him now that he is not a minor?

The plaintiff can sue up to the two year anniversary of the accident, which is what they have done in your nephew's case. Report it to your automobile insurance company or the insurer for the car your nephew was driving right away. Your nephew must file a written response with the court within 30 days from the date he is served with the lawsuit.

Are they maybe taking some money from me?

Answered by attorney Diana L. Anderson
Personal Injury lawyer at Diana L. Anderson
If the arbitration was not binding, then one or the other side can apply for a "trial de novo" or a new hearing.  Just because the arbitrator said a number doesn't mean its over.  The defendant must be contesting the number, and your attorney is trying to settle without having to go through the whole process.
