Should I send in a letter to my insurance provider?

Answered by attorney Mark Tischhauser
Personal Injury lawyer at Tischhauser Law Group
You can, but they will likely do an investigation and make thier own determination. Biggest issue s it sounds like dogs were not leashed and there may be a dispute as to what actually happened, so you'll have to sort this out with insurance, if they insure dog issues, or hire your own lawyer to address the issue if not, as simply calling claimant a liar does noting to resolve the issue. If you have questions and would like a FREE consultation, simply contact our office at 1-800-922-6442.

What can I do if I was fired because of injuries?

Answered by attorney Robert Morrison Lucky (Unclaimed Profile)
Personal Injury lawyer at The Lucky Law Firm, PLC
Louisiana is an employment at-will state. Therefore, employees may be fired for pretty much any reason whatsoever, as long as not for discrimination of certain types. Also, there are some limitations if on terminating employees if the employee was actually injured on the job. If you were injured on the job, then there will be certain things that you are required to do.

Is $3,500 a fair settlement for my son's pain and suffering?

default-avatar
Answered by attorney Richard T. Robol (Unclaimed Profile)
Personal Injury lawyer at Robol Law Office LPA
There is no magic formula to determine pain and suffering. Each case turns on its own individual facts. Frequently, lawyers take a multiple of 3-5 times the amount of special damages (e.g. costs of medical care, prescriptions, lost wages) as a rough guide of what is a "fair sum" for pain and suffering. But a number of other facts should be considered, such as the age and background of the victim (in this case, a 15 year-old boy); whether there will be future pain and suffering/permanency of the injury (here, apparently no permanency or future pain and suffering); and other factors. Typically, insurance companies make "low ball" offers to victims who are not represented by counsel. But, ultimately, the decision what is an acceptable resolution sits with the client.
