Estate Planning & Tax Planning: I will review your assets and recommend solutions to best avoid estate taxes or gift taxes while implementing your goals. I will help you implement a plan for the orderly distribution of assets and will prepare all the documents required to put your estate plan into place, including wills, trusts, powers of attorney, and advance medical directives.
Medicaid and Nursing Home Planning: (1) I work with clients that seek to protect assets years in advance of needing nursing home care. I will explain the Medicaid requirements and process. Based on the client's unique situation, I will recommend an asset protection plan that will protect assets while achieving the client's goals. (2) I work with clients that are now in the nursing home or will soon be in the nursing home. These clients will not be able to implement the same asset protection solutions as clients that planned in advance. I work with these clients to properly address all Medicaid requirements and to implement the various methods of protecting assets that are available at this late stage in the process.
Medicaid Applications and Appeals: I assist clients in preparing the Medicaid application. More importantly, I work with the client to prevent problems with the application. I know what are problem issues with Medicaid and I can work with you to correct those problems. I also take the burden off of you as I will go through all the paperwork and records to properly prepare the application for you. If the client's application was denied, I will work to correct any problems and appeal the application.
VA Benefits: Many veterans and their spouses fail to obtain valuable VA benefits. These benefits, called "Aid and Attendance" pension benefits are paid to the veteran or his/her family to offset the cost of nursing home care, in-home care, or assisted living costs.
VA Benefits & Medicaid: Because the rules for obtaining VA Aid and Attendance benefits and Medicaid Benefits are vastly different, it takes a skilled lawyer to assist clients in obtaining both benefits. I work with my clients to make sure they properly plan so that there is no loss of either benefit.
Probate and Estate Administration: I assist clients through all aspects of the probate process, including: probating simple estates, complex estates, and insolvent estates; probating with or without a will; will contests; disputes with personal representatives over misuse of estate resources; conservatorship, guardianships, and commitment proceedings.
