About David Salazar

David Salazar is a Partner at the firm's Miami office. Having tried construction cases throughout Florida, Mr. Salazar is a trial lawyer, who also provides consultation on transactional matters. With over 20 years of experience, he is a Board Certified Specialist in Construction Law, and a fellow of the Construction Lawyers Society of America (CLSA), an invitation-only organization with fewer than 100 members in the state.

Mr. Salazar devotes his practice to a broad array of construction-related matters, representing developers, contractors, and subcontractors in construction defect, delay, contract, and lien enforcement claims. He also represents design professionals in professional liability claims and businesses in large-scale civil and commercial litigation. He handles cases arising from a number of sub-disciplines in road construction, including, but not limited to, design deficiencies, improper product selection, cost overruns, defects, and maintenance of traffic. He is routinely involved in cases where the amounts in dispute exceed $20,000,000.00. Mr. Salazar writes and speaks about construction law as well as banking and finance, among other topics.

Mr. Salazar enjoyed a great deal of academic success and earned a Bachelor of Science from the University of Florida and a Juris Doctor from Stetson University.

Since becoming a lawyer in 2006, Mr. Salazar has been recognized by various notable organizations. For example, he served as the Co-Chair of the Young Lawyers Division of the Florida Defense Lawyers Association (“FDLA”) from 2007 to 2008. He was re-inducted as Co-Chair for three administrations, from 2008 to 2011. In 2013, Mr. Salazar served as Vice-Chair of the Construction Law Committee of the Miami-Dade Bar. In 2014, he also served as Co-Chair and, in 2015, as Board Chairperson.

Since 2022, Mr. Salazar has been recognized by Best Lawyers in America, a recognition awarded to the top 5.3% of elite lawyers in the nation across 150 practice areas. Each year from 2012 to 2016, he was named a rising star in construction litigation by Florida Super Lawyers Magazine. After aging out of the rising star category, he was recognized as a Super Lawyer by Florida Super Lawyers Magazine every year from 2019 to 2024. In 2010, he was awarded the James A. Dixon Young Lawyer of the Year Award by the FDLA. Mr. Salazar was also named one of Florida Trend’s Legal Elite Up-and-Comers, each year from 2008 to 2010 and The Cystic Fibrosis Foundation named him one of Miami-Dade County’s 40 under 40 Outstanding Lawyers in 2009.

An active member of prestigious organizations, including the Trial Lawyers Section of the Florida Bar, the Real Property, Probate and Trust Law Section of the Florida Bar, and the South Florida Chapter of the Associated General Contractors of America, Mr. Salazar is well-connected within the legal and construction communities.

    Secured final summary judgment on behalf of general contractor in a construction defect matter involving a luxury home in Miami Beach based on the Plaintiffs' failure to produce an assignment unambiguously transferring them the legal rights of the prior owner of the home. Before that, obtained a dismissal with prejudice of a cause of action based on the implied warranty of habitability because the construction at issue was a home renovation (not construction of a new home)
    because the general contractor was not the builder, developer, or seller of the renovated home. The Plaintiffs' claims exceeded $1mm. (Lead Counsel).
    Obtained final summary judgment on behalf of civil engineer in multi-million dollar negligence suit, based upon the Slavin doctrine

    Secured dismissal with prejudice of claims for nuisance, implied condominium warranties,
    special damages - including stigma damages - on behalf of general contractor in loss of use
    defect claim at a high-end condominium

    Secured favorable settlement on behalf of hotel developer in a construction lien, delay,
    defect dispute in Federal Court where the amounts in controversy exceeded $10mm. (Lead Counsel).
    Secured confidential settlement the client deemed highly favorable after a week of trial in a multi-faceted construction defect case where the Plaintiffs sought millions of dollars in damages allegedly resulting from the construction of a luxury single-family home
    obtained partial directed verdict on one of the key counts at the close of Plaintiffs' case. (Lead Counsel).
    Part of team that secured favorable confidential settlement in $40mm lien foreclosure claim on behalf of developer. (Co-Counsel).
    Negotiated in excess of 70 favorable settlements on behalf of general contractor for claims based upon loss of use, damaged property,
