About Jackson Schroeder

Jackson is a partner at Bose McKinney & Evans who focuses his practice on administrative litigation, environmental litigation and insurance coverage disputes. He understands that these situations can place clients under enormous stress. He listens to his clients’ stories, questions and goals and tailors a litigation strategy to their needs.

Administrative Litigation

Jackson helps clients who want agency action challenged or defended. He has experience representing clients who want agency action overturned. This includes briefing and arguing a petition for judicial review and successfully overturning orders issued by the Indiana Department of Labor/Indiana Occupational Safety and Health Administration. See cause no. 49D13-2106-PL-018812 (overturning orders issued by IDOL/IOSHA and ordering government to pay nearly $400,000 in attorney’s fees, costs, and expenses).

Jackson has experience representing clients who want agency action affirmed. For example, Jackson first chaired a two-day administrative bench trial that resulted in the administrative court upholding a DNR permit issued to his client. See administrative cause number 23-041W, OALP cause no. DNR-2506-002053. In addition, his experience includes excluding an opposing party’s expert and receiving summary judgment affirming a DNR permit issued to Jackson’s client. See administrative cause no. 21-027W, 16 CADDNAR 27.

Jackson also has experience defending agency action on judicial review, including briefing and arguing a response to a petition for judicial review that resulted in the trial court affirming the agency action that was favorable to his client. See cause no. 22D03-2312-PL-001650.

Jackson’s experience further includes briefing appeals that have resulted in the Indiana Court of Appeals affirming agency action that was favorable to his client and affirming the dismissal of collateral attacks on the favorable agency action. See 2025 WL 2472974; 2025 WL 2473111.

Environmental Litigation

Jackson helps clients who have environmental law issues, including those arising from Indiana statutes (ELA, Flood Control Act, etc.), federal statutes (CERCLA, RCRA, etc.), regulatory bodies (IDEM, DNR, EPA, etc.), common law (negligence, trespass, nuisance, etc.) and more.

Jackson’s experience includes briefing summary judgment on an ELA claim that resulted in a favorable summary judgment order. See cause no. 20D02-2008-CT-000170. He also has experience opposing class certification and briefing motions to exclude experts in toxic tort cases.

When litigating toxic tort cases, Jackson has experience removing to federal court under the Class Action Fairness Act and successfully opposing remand to state court. 2024 WL 1956211. Jackson’s experience further includes applying the unique federal standing requirement in the context of environmental litigation and securing dismissal of certain claims for lack of standing under Article III of the Constitution. 2024 WL 4986613.

Insurance Coverage Disputes

Jackson helps people and businesses that have had their insurance claim denied. He knows that claim denials can have catastrophic effects on businesses and individuals. He evaluates a claim denial to determine if the insurance company wrongly denied coverage. When an insurance company has wrongfully denied a claim, Jackson is prepared to draft coverage dispute letters and litigate on behalf of his clients.

Jackson has experience drafting letters to insurance companies that have resulted in insurance companies agreeing to defend clients from lawsuits, including reversing prior coverage denials. He also has experience litigating coverage disputes against insurance companies
