The first thing you do is have a full consult with a competent immigration attorney to determine if your husband is allowed to file in the US or only out of it. The latter will trigger a ten year bar and you will have to file an extreme hardship waiver to try to overcome that. I am happy to do a consult with you, which takes about one hour and is $150. Otherwise please make an appointment with another immigration attorney!

When you marry someone who is here illegally, they do not automatically become citizens or obtain legal status. You must file a petition for them to become legal permanent residents. The same goes for his children, and depending on their ages, they may or may not be included in the petition.

You should seek advice from a general practice attorney but my recollection is that you need to file a Petition in the State court after advertising for a considerable period of time (advertisement must comply with the requirements of the statute). Then you submit the name change order to the Judge and with this new Decree you can correct all of your other documents.
