Pardon waiver after visa interview

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
You are eligible for an I-601 waiver for your illegal stay in the U. S. The application is based on establishing extreme hardship to your mother and father if you cannot return to this country. Such applications should include statements by you, your parents, and documentary evidence as to why your parents would suffer extreme hardship if you were separated and also if they move permanently to Mexico to stay with you. The application is submitted to the U.S.C.I.S. lockbox in Phoenix, Arizona with fee of $585. If sending by U.S. Postal Service, send to: U.S.C.I.S. PO Box 21600 Phoenix, AZ 85036 If sending by express mail or courier: U.S.C.I.S. ATTN: 601/212 Foreign Filers 1820 E.Skyharbor, Circle S, Suite 100 Phoenix, AZ 85034 Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question. Can I change my status online or should I go to the immigration in person?

default-avatar
Answered by attorney Michael Alexander Yurasov-Lichtenberg (Unclaimed Profile)
Immigration lawyer at Havens Lichtenberg PLLC
You cannot change your status online, and a personal visit to the USCIS will gain you nothing. You wife has to file an immigrant petition for you (Form I-130). It should be filed together with your application for adjustment of status (Form I-485), employment authorization (Form I-765), advance parole (Form I-131), and your wife's affidavit of support (Form I-864). All these forms can be found at uscis.gov, along with the instructions for each form. Technically, one is supposed to be able to fill out and file all these forms just by following the instructions. Most people try - and go to an immigration attorney for help. The rest go to an immigration attorney after their done-by-themselves applications get denied and $1490 in filing fees paid to USCIS, lost.

Will my fiancé’s visitor’s visa being denied affect my I-130 application for him when we get married soon?

Answered by attorney Bruce A. Coane (Unclaimed Profile)
Immigration lawyer at Coane & Associates, PLLC
Generally, under the law, the denial of a B-2 visa should have little or no effect on the visa interview for an approved I-130.
