How do I petition my mother to become an American citizen?

Fakhrudeen Hussain
Answered by attorney Fakhrudeen Hussain (Unclaimed Profile)

If you are a US citizen, you can petition for your mother. If you mother entered the US with a visa you can file the Green Card application along with the petition. If she entered illegally and nobody has filed a petition for before 04/31/2001, then after the petition is approved, she will have to file a waiver for her unlawful presence and then if that is approved she will have to go back to her country and come back with a immigrant visa.

Will my petition get approved if my boyfriend was deported voluntarily and he arrived illegally to the US at the age of 15?

You cannot file the visa petition until you are married to the beneficiary. The petition can be approved despite his prior record, but that does not guarantee he will get an immigrant visa. You should retain an immigration attorney.

If you are a USC, you can file a visa petition for your spouse, and depending upon her manner of entry into the US, she may be able to apply for adjustment of status. If you are not a USC, her USC parents may be able to petition for her. She should consult an immigration attorney.
